USDT Gambling, Taxes and Local Laws: What Players Should Know
Whether you can gamble with USDT, and whether you owe tax on winnings, depends on the country you live in - not on the coin or the casino. The four casinos we rate hold offshore licences rather than local ones: Stake and Jack are licensed by the Curaçao Gaming Authority (OGL/2024/1451/0918 and OGL/2024/1562/1139), Qzino by Anjouan (ALSI-202503015-FI1), and Rakebit also holds an Anjouan licence, and every one of them requires players to be 18+ or the local legal age.
This page explains the general picture. It is not legal or tax advice, and we never quote tax rates, because they vary by country and change over time. If real money is involved, talk to a qualified adviser where you live.
Is gambling with USDT legal?
There is no single answer. Online gambling rules differ by country, and in some places by region. Paying in USDT does not change the legal status of the gambling itself - the stablecoin is just the payment method.
What you can check yourself:
- Your local law. Rules differ from country to country. Find out what applies to you before you sign up anywhere.
- The casino's terms. Every casino publishes a list of countries it does not accept. If your country is on it, do not play there.
- Your age. You must be 18+, or older if your local legal age is higher.
In most countries the rules target operators, not players. That is a general observation, not a promise about where you live - check your own situation.
What does an offshore licence mean?
Offshore crypto casinos hold licences from places like Curaçao or Anjouan, not from the country where you live. Here is how the casinos we rate are licensed:
| Casino | Licensing authority | Licence |
|---|---|---|
| Stake | Curaçao Gaming Authority | OGL/2024/1451/0918 (operator Medium Rare N.V.) |
| Jack | Curaçao Gaming Authority | OGL/2024/1562/1139 (operator Data Link Digital B.V.) |
| Qzino | Government of the Autonomous Island of Anjouan, Union of Comoros | ALSI-202503015-FI1 (operator CG Universe LLC) |
| Rakebit | Anjouan gaming licence | number not shown on the site |
A licence tells you who regulates the operator. It does not mean the casino is licensed in your country, and it does not override your local law. Our reviews of Stake, Rakebit, Jack and Qzino cover each operator in more detail.
Where can't you play?
Each casino keeps its own list of restricted countries, and they differ a lot. The notes below are generated from each casino's current terms:
- Stake:
Stake does not accept players from: Afghanistan, Alberta, Argentina, Australia, Austria, Belgium, Brazil, Cayman Islands, Colombia, Congo - Kinshasa, Croatia, Cuba, Curaçao, Cyprus, Czechia, Denmark, France, Germany, Greece, Iran, Iraq, Ireland, Israel, Italy, Liberia, Libya, Lithuania, Malta, Mexico, Netherlands, North Korea, Ontario, Peru, Poland, Portugal, Serbia, Slovakia, South Africa, South Sudan, Spain, Sudan, Sweden, Syria, United Kingdom, United States, Zimbabwe. Check the casino terms for the full list and your local law before playing.
- Rakebit:
Rakebit does not accept players from: China, Costa Rica, Portugal, Russia, Singapore, Thailand, Ukraine, United States. Check the casino terms for the full list and your local law before playing.
- Jack:
Jack does not accept players from: Belarus, Georgia, Latvia, Lithuania, Moldova, Russia, Ukraine. Check the casino terms for the full list and your local law before playing.
- Qzino:
Qzino does not accept players from: Australia, Netherlands, Spain, United Kingdom. Check the casino terms for the full list and your local law before playing.
If you live in a restricted country, do not try to get around the block - playing from there breaks the casino's own terms, and that puts your balance at risk. The casino's terms are what count, so read them yourself before you deposit.
Do you pay tax on casino winnings in USDT?
It depends on the country. Taxes on winnings follow the rules where you live, and we do not quote rates because they vary and change.
With USDT there can be a second layer: the crypto itself. Even though USDT is designed to track the dollar, some tax systems look at crypto transactions separately from gambling. Questions worth asking an adviser:
- Are gambling winnings taxable where I live, and does it matter whether the casino is licensed locally or offshore?
- Does buying, selling or swapping USDT count as a taxable event in my country?
- If I convert USDT to USDC or another coin, does that need to be reported?
- Do I need to declare crypto held in a casino account or in a self-custody wallet?
- Can gambling losses be set against winnings where I live?
- What records will the tax authority expect me to keep?
None of these have a universal answer. That is exactly why a local professional is worth the call if your amounts are meaningful.
What records should you keep?
Good records cost nothing and save a lot of stress later, whether for taxes or for questions from your exchange when you cash out.
- Purchase records. Date, amount paid and USDT received at the exchange.
- Deposit transactions. Transaction ID, network (TRC20, ERC20, BEP20, Solana or TON), amount and casino.
- Withdrawal transactions. Transaction ID, network, amount, date and the receiving address.
- Casino history. Most casino accounts show a transaction history - export or screenshot it regularly.
- Conversions. Any swap between USDT and another coin, including in-casino swaps or converters.
- Exchange cash-outs. When you sell USDT for local currency, keep the statement.
A simple spreadsheet with one row per transaction is enough for most players. Our guide on how to withdraw USDT safely explains where to find transaction IDs.
Why can an exchange ask about your casino funds?
When you move USDT from a casino to a regulated exchange and sell it, the exchange may ask where the funds came from. That is normal for a regulated business. Having your casino history and transaction IDs ready makes the conversation short.
Casinos can ask similar questions. Qzino, for example, may request ID, a utility bill, a selfie and source of funds. Jack can request verification for large withdrawals or flagged activity. Rakebit asks for no documents to withdraw, with anti-fraud checks only in exceptional cases - but that does not change your own obligations at home.
Does a stablecoin protect you legally?
No. USDT keeps your balance close to the dollar, but stablecoins are not bank deposits, and holding them does not change the legal status of gambling where you live. Transfers are irreversible, so a payment sent to a casino you should not have used cannot be pulled back.

FAQ
Do I have to pay tax on USDT casino winnings?
It depends on your country. Taxes on winnings vary from place to place, and crypto may be treated separately. Ask a qualified adviser where you live.
Is a Curaçao or Anjouan licence valid in my country?
These are offshore licences. They regulate the operator but are not local licences, so they do not override the law where you live.
Why does each casino have a different list of restricted countries?
Each operator sets its own list in its terms based on its licence and policies. Always check the casino's current terms before signing up.
Does using USDT make gambling anonymous for tax purposes?
No. Blockchain transactions are recorded publicly, and exchanges may ask where funds come from. Your tax obligations stay the same whichever payment method you use.
What is the minimum age to gamble with USDT?
You must be 18+, or the local legal age if it is higher.
Gamble only with money you can afford to lose; 18+.
